ARTICLE 1: Purpose

The purpose of these “general terms and conditions of use” is to provide legal guidance on how to provide the services of the Serado site and their use by “the user”.

The general terms of use must be accepted by any user who wants to access the site. They are the contract between the site and the user. Access to the site by the user means its acceptance of these general terms of use.

  • In case of non-acceptance of the general conditions of use stipulated in this Agreement, the user must renounce the access of the services offered by the site.

ARTICLE 3: Definitions

The purpose of this clause is to define the various essential terms of the contract:

  • User: This term refers to any person who uses the site or any of the services offered by the site.
  • User content: This is the data transmitted by the user within the site.
  • Member: The user becomes a member when he is identified on the site.

ARTICLE 5: Intellectual Property

Trademarks, logos, signs and other content of the site are subject to protection by the intellectual property Code and, more specifically, by copyright.

The user requests the prior authorisation of the site for any reproduction, publication, copy of the various contents.

The user agrees to use the contents of the site in a strictly private setting. A use of the contents for commercial purposes is strictly forbidden.

Any content put online by the user is his sole responsibility. The user agrees not to put online any content that may affect the interests of third parties. Any legal action brought by a third party against the site will be taken care of by the user.

The content of the user can be at any time and for any reason deleted or modified by the site. The user does not receive any justification and notification prior to deleting or modifying user content.

ARTICLE 6: Personal Data

In no event shall the data collected on the serado.ch site be transferred or sold to third parties. No email address will be transmitted to third parties including our partners except with the written consent of the stakeholders. The data collected through the contact form are intended for the exclusive use of the serado.ch Manager in order to contact you and are not the subject of marketing prospecting.

ARTICLE 7: Responsibility and Force majeure

The sources of information disseminated on the site are considered reliable. However, the site reserves the possibility of a non-guarantee of the reliability of the sources. The information provided on the site is purely informative. Thus, the user assumes sole responsibility for the use of the information and contents of this site.

Any use of the service by the user directly or indirectly as a result of damages on this service must be compensated for the benefit of the site.

An optimum guarantee of the security and confidentiality of the transmitted data is not ensured by the site. However, the site is committed to implementing all the necessary means to ensure the best possible security and confidentiality of the data.

The responsibility of the site cannot be committed in case of force majeure or the unpredictable and insurmountable fact of a third party.

Many outgoing hyperlinks are present on the site, however the Web pages where these links do not commit the responsibility of serado which does not have control of these links.

ARTICLE 9: Evolution of the contract

The site reserves the right to modify the terms and conditions of this agreement at any time.

ARTICLE 10: Duration

The term of this agreement is undetermined. The contract produces its effects with respect to the user as from the use of the service.

ARTICLE 11: Applicable law and competent court

The French legislation applies to this contract. If there is no amicable resolution of a dispute between the parties, only the courts of the city of Toulouse are competent.

ARTICLE 12: Publication by the user

The site allows members to post comments.

In its publications, the member agrees to abide by the rules of the Netiquette and the rules of law in force.

The site exercises a moderation on the publications and reserves the right to refuse to put it online, without having to justify it to the member.

The member remains the full owner of his or her intellectual property rights. But by publishing a publication on the site, it gives the publisher the non-exclusive and free right to represent, reproduce, adapt, modify, disseminate and distribute its publication, directly or by an authorized third party worldwide, on any Support (digital or physical), for the duration of the intellectual property. In particular, the member gives up the right to use its publication on the Internet and on mobile telephony networks.

The publishing company agrees to include the name of the member in the vicinity of each use of its publication.
